As from 1 April 2013 the following provisions have effect1. The Secretary of State2 may enter into an agreement with another person for an approval function3 of the Secretary of State to be exercisable by the Secretary of State concurrently with that other person and, if a requirement to exercise such an approval function by the National Health Service Commissioning Board or a special health authority4 has effect, with the other person by whom the function is exercisable under that requirement5.
