A best interests assessment is an assessment of whether the relevant person1 meets the best interests requirement2.
In carrying out a best interests assessment, the assessor3 must comply with the following duties4. The assessor must consult the managing authority5 of the relevant hospital or care home6 and must have regard to the conclusions which the mental health assessor has notified to the best interests assessor7, any relevant needs assessment8 and any relevant care plan9.
The managing authority must give the assessor a copy of any relevant needs assessment carried out by them, or on their behalf, or any relevant care plan
