A patient1 who is subject to Part 3 of the Mental Health Act 19832 (that is, provisions relating to criminal offenders) who is admitted to hospital3 in pursuance of a hospital order or who is placed under guardianship by a guardianship order, and who thus falls to be treated as a patient under Part 2 of the Mental Health Act 1983 for certain purposes4, has the same rights of application to an appropriate tribunal5 as Part 2 patients under certain6 provisions7.
