At a hearing1 before: (1) the investigating committee2 which relates to an allegation3 that an entry in the register4 has been fraudulently procured or incorrectly made or any matter which is treated as such an allegation5, or whether to make, revoke, confirm, vary or replace an interim order6; (2) the fitness to practise committee7; or (3) the Nursing and Midwifery Council on an appeal against a decision of the registrar8, any advice tendered by a legal assessor9 to the Council or a committee must be given in the presence of every party, or person representing a party, in attendance
