The provisions below come into force in substance on 1 June 2019: SI 2019/857.
Where a landlord or a letting agent1 breaches (1) the prohibitions2 on tenant fees applying to landlords or letting agents, as a result of which the landlord or letting agent, or a third party, receives a prohibited payment3 from a relevant person4 and all or part of the prohibited payment has not been repaid to the relevant person; or (2) the requirements relating to holding deposits5 paid by a relevant person and all or part of the holding deposit has not been repaid to the relevant
