The provisions below come into force in substance on 1 June 2019: SI 2019/857.
Where an enforcement authority1 (1) imposes a financial penalty2 on a landlord or letting agent for breaching the prohibitions on tenant fees applying to landlords or letting agents3; (2) is satisfied on the balance of probabilities that the breach resulted in a relevant person making a prohibited payment to a landlord, letting agent or third party; and (3) is satisfied on the balance of probabilities that all or part of the prohibited payment4 has not been repaid to the relevant person5, the enforcement authority may require
