The provisions below come into force in substance on 1 June 2019: SI 2019/857.
A person commits an offence if (1) he breaches the prohibitions1 on tenant fees applying to landlords or letting agents2; (2) a relevant penalty3 has been imposed on him in respect of a different breach of the same prohibition and the final notice imposing the penalty has not been withdrawn, or he has been convicted of an offence in respect of such a breach; and (3) the breach mentioned in head (1) occurs within the period of five years beginning with the day on which the
