Most provisions of the Landlord and Tenant (Covenants) Act 19951 apply only to 'new tenancies'2. For these purposes, a tenancy3 is a 'new tenancy' if it is granted on or after 1 January 19964 otherwise than in pursuance of:
(1) an agreement entered into before that date5; or
(2) an order of a court made before that date6;
and heads (1) and (2) above apply7 to the grant of a tenancy where by virtue of any variation of a tenancy there is a deemed surrender and regrant as it applies to any other grant of a tenancy8.
