The following provisions have effect1 for the purpose of determining who is the statutory tenant2 of a dwelling house by succession after the death of the person ('the original tenant') who died on or after 15 January 19893 and who, immediately before his death, was a protected tenant4 of the dwelling house or the statutory tenant of it by virtue of his previous protected tenancy5.
The surviving spouse or surviving civil partner, if any, of the original tenant, if residing6 in the dwelling house immediately before the death of the original tenant, becomes the statutory tenant after the death if
