901. Succession to assured tenancy in England.

The Housing Act 1988 makes provision for succession to an assured tenancy and, as from 1 April 2012, the following provisions have effect in England (subject to certain transitional provisions)1.

In any case where2:

(1)     the sole tenant under an assured periodic tenancy3 dies4; and

(2)     immediately before the death, the tenant's spouse or civil partner5 was occupying the dwelling house6 as his or her only or principal home7,

then, on the death, the tenancy vests in the spouse or civil partner (and, accordingly, does not devolve under the tenant's will or intestacy)8, unless the tenant was himself a successor9.
