Where the person who is the original tenant1 or the first successor2 dies after 15 January 19893, the provisions of the Rent Act 1977 that allow a spouse of a deceased tenant, or a family member, to succeed to a statutory tenancy4 are modified by the Housing Act 19885.
In any case where, by virtue of any provision that is modified in this way6, a person ('the successor') becomes entitled to an assured tenancy of a dwelling house7 by succession, that tenancy is a periodic tenancy arising8 by statute9, and it is one:
