902. Succession to assured periodic tenancy in Wales and in transitional cases in England.

As from 1 April 20121, the following provisions have effect in relation to Wales and (in transitional cases only) England2.

In any case where:

(1)     the sole tenant3 under an assured periodic tenancy4 dies5; and

(2)     immediately before the death, the tenant's spouse or civil partner6 was occupying the dwelling house7 as his or her only or principal home8; and

(3)     the tenant was not himself a successor9,

then, on the death, the tenancy10 vests in the spouse or civil partner (and, accordingly, does not devolve under the tenant's will or intestacy)11.

For these purposes, a tenant is a successor in relation to a tenancy
