639. Service charge contributions to be held in trust.

The following provisions apply where:

  1.  

    (1)     the tenants1 ('the contributing tenants') of two or more dwellings2 may be required under the terms of their leases3 to contribute to the same costs; or

  2.  

    (2)     the tenant ('the sole contributing tenant') of a dwelling may be required under the terms of his lease to contribute to costs to which no other tenant of a dwelling may be required to contribute,

by the payment of service charges4. For these purposes, 'tenant' does not, however, include a tenant of an exempt landlord5.
