1194. Rights where tenant occupies under trust or settlement.

A tenant1 of a house2 is to be treated3 as having been a tenant of it at any earlier time if at that time:


    (1)     the tenancy4 was settled land5 and he was sole tenant for life6; or


    (2)     the tenancy was vested in trustees7 and he, as a person beneficially interested, whether directly or derivatively, under the trusts was entitled or permitted to occupy the house by reason of that interest
