Privity of contract remains between the original landlord and the original tenant even after the assignment of the lease1. Consequently, the liability of the original tenant to the original landlord continues notwithstanding that the lease has been assigned and notwithstanding that the original landlord has a remedy against the assignee for the rent and on the covenants running with the land and notwithstanding a surrender of part of the demised premises or a variation in the terms of the lease agreed between the landlord and the assignee in respect of the period for which the assignee holds the term2.
