Where a tenancy of a dwelling1 requires the tenant2 to insure the dwelling with an insurer nominated or approved by the landlord3, the tenant or the landlord may apply to the County Court4, or the appropriate tribunal5, for a determination whether6:
(1) the insurance which is available from the nominated or approved insurer for insuring the tenant's dwelling is unsatisfactory in any respect7; or
(2) the premiums payable in respect of any such insurance are excessive8.
No such application may, however, be made in respect of a matter which:
(a) has been agreed or admitted by the tenant9;
