A covenant or agreement, whether contained in a lease to which the statutory provisions implying a covenant by the lessor to repair apply1, or in an agreement collateral to such a lease, is void in so far as it purports:
(1) to exclude or limit the implied obligations of the lessor2 or the implied immunities of the lessee3; or
(2) to authorise any forfeiture or impose on the lessee any penalty, disability or obligation in the event of his enforcing or relying upon those obligations or immunities4,
unless the inclusion of the provision was authorised by the court5.
