612. Restriction on liability for payment of service charge after assignment.

The Landlord and Tenant (Covenants) Act 1995 restricts the liability of a former tenant who has assigned his tenancy but who:

  1.  

    (1)     in the case of a tenancy which is a new tenancy1, has under an authorised guarantee agreement2 guaranteed the performance by his assignee of a tenant covenant of the tenancy under which any fixed charge (which includes any service charge)3 is payable; or

  2.  

    (2)     in the case of any tenancy, remains bound by such a covenant
