The Housing Act 1988 follows the Rent Acts by excluding from its protection1 certain tenancies granted by resident landlords; but, whereas, under the Rent Acts, a tenancy which fell within the resident landlord exemption was a restricted contract2, a tenancy which falls within the resident landlord exemption under the Housing Act 1988 has no statutory protection save that, by virtue of the Protection from Eviction Act 1977, the landlord must obtain a possession order before evicting the tenant3.
Under the Housing Act 1988, a tenancy4 in respect of which the following conditions are fulfilled5 cannot6 be an assured tenancy7:
