A tenant1 under an assured shorthold tenancy2 of a dwelling house3 in England4 is entitled to a repayment of rent from the landlord5 where6:
(1) as a result of the service of a notice stating that he requires possession of the dwelling house7, the tenancy8 is brought to an end before the end of a period of the tenancy9;
(2) the tenant has paid rent in advance for that period10; and
(3) the tenant was not in occupation of the dwelling house for one or more whole days of that period11.
