If at any time during a serviceman's1 period of residence protection2:
(1) a tenancy qualifying for protection3, which is a fixed term tenancy4, ends5 without being continued or renewed by agreement, whether on the same or different terms and conditions6; and
(2) on the ending of that tenancy, no statutory periodic tenancy7 of the rented family residence8 would otherwise arise, by reason only of such circumstances as are mentioned in heads (i) to (iv) below9,
the Housing Act 1988 provisions that relate to assured tenancies10 apply, during the remainder of the period of protection, in relation to the rented family
