The parties to an agreement for an apportionment of liability under a non-attributable covenant of a tenancy1 are taken2 to apply for such an apportionment to become binding on the appropriate person3 if (either before or within the period of four weeks beginning with the date of the assignment4 in question) they serve5 on that person a notice6 informing him of:
(1) the proposed assignment (or, as the case may be, the fact that the assignment has taken place)7;
(2) the prescribed particulars of the agreement8; and
(3) their request that the apportionment should become binding on him9.
