The following provisions apply to:
(1) a statutory periodic tenancy1 other than one which cannot2 for the time being be an assured tenancy3; and
(2) any other periodic tenancy which is an assured tenancy, other than one in relation to which there is a provision, for the time being binding on the tenant4, under which the rent for a particular period of the tenancy will or may be greater than the rent for an earlier period5 (such as a rent review clause)6.
