757. Premiums on grant, renewal or continuance of protected tenancy.

Any person1 who either:

  1.  

    (1)     as a condition of the grant, renewal or continuance2 of a protected tenancy3, requires4, in addition to the rent, the payment5 of any premium6 or the making of any loan, whether secured or unsecured7; or

  2.  

    (2)     in connection with the grant, renewal or continuance of a protected tenancy, receives any premium in addition to the rent8,

is guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale9. The court by which a person is convicted of such an offence relating to requiring or receiving any
