Subject to certain exceptions1, any person2 who either:
(1) as a condition of the assignment of a protected tenancy3, requires4 the payment of any premium5 or the making of any loan, whether secured or unsecured6; or
(2) in connection with the assignment of a protected tenancy receives any premium7,
is guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale8. The court by which a person is convicted of such an offence relating to requiring or receiving any premium may order the amount of the premium, or so much of
