No application for an order appointing a manager1 may be made to the appropriate tribunal2, unless:
(1) in a case where a preliminary notice has been served by the tenant3, either:
(a) the specified period4 has expired without the person required to take steps to remedy the specified matters having taken the steps that he was required5 to take6; or
(b) no person was required7 to take such steps
