1242. Payment into court in cases of difficulty.

Where a house1 and premises2 are on a conveyance to the tenant3 to be discharged of any charge4 and a person is or may be entitled5 in respect of the charge to receive the whole or any part of the price payable for the house and premises, then, if:


    (1)     for any reason difficulty arises in ascertaining how much is payable in respect of the charge; or


    (2)     for any specified reason6 difficulty arises in making a payment in respect of the charge,

the tenant may pay into court on account of the price for the house and premises the
