Where it is agreed between the landlord and the tenant1, or determined by the court, that the terms of the statutory tenancy are to include the carrying out of specified repairs ('initial repairs'), and any of the initial repairs are required in consequence of the failure by the tenant to fulfil his obligations under the former tenancy2, the landlord is entitled to a payment (a 'payment for accrued tenant's repairs') of an amount equal to the cost reasonably incurred by the landlord in ascertaining what repairs are so required and in carrying out such of the initial repairs as
