A tenancy from year to year1 arises either by express agreement or by implication of law or by statute2. It may be determined only by notice duly given3 except where there is a stipulation for determination without notice4. The appropriate words for the express creation of the tenancy are 'from year to year'. The agreement may stipulate the time and length of any notice required to determine the tenancy5; but, in the absence of any such stipulation and of any statutory provision preventing determination6, the tenancy may be determined at the end of the first or any subsequent year7,
