The persons who are entitled to be members of a company which is an RTM company1 in relation to premises are:
(1) qualifying tenants2 of flats3 contained in the premises4; and
(2) from the date on which it acquires the right to manage5 (referred to as the 'acquisition date'), landlords6 under leases7 of the whole or any part of the premises8.
Any agreement relating to a lease, whether contained in the instrument creating the lease or not and whether made before the creation of the lease or not, is void in so far as it:
