660. Meaning of 'protected tenancy'.

A tenancy1 entered into before 15 January 19892 under which a dwelling house, which may be a house or part of a house, is let as a separate dwelling3 is, subject to the provisions of Part I of the Rent Act 19774, a protected tenancy for the purposes of that Act5. A tenancy is not, however, a protected tenancy if:

  1.  

    (1)     the tenancy was entered into before 1 April 1990 and the rateable value of the house exceeds certain limits6; or

  2.  

    (2)     the tenancy was entered into on or after 1 April 1990 and the rent for the time
