305. Leases to which the statutory repairing obligations apply.

The statutory provision that implies a covenant by the lessor to repair1 applies to leases of a dwelling house2 granted on or after 24 October 1961 for a term of less than seven years3. That provision also applies to a lease of a dwelling house in England granted on or after 1 April 20124 which is:

  1.  

    (1)     a secure tenancy for a fixed term of seven years or more granted by a person5 within the landlord condition for secure tenancies6; or

  2.  

    (2)     an assured tenancy7 for a fixed term of seven years or more that is not a shared
