A qualifying tenant1 of a flat2 may not participate in the giving of a relevant notice of claim3 if on the date when the notice is given:
(1) any person or body of persons who has or have been, or could be, authorised to acquire the whole or part of the flat compulsorily for any purpose has or have, with a view to its acquisition for that purpose, either served a notice to treat on that tenant, or entered into a contract for the purchase of his interest4 in the whole or part of the flat; and
