368. Improvements to let dwelling houses occupied by a disabled person.

In relation to a lease1 of a dwelling house, if each of the following applies:

  1.  

    (1)     the tenancy is not a protected tenancy2, a statutory tenancy3 or a secure tenancy4;

  2.  

    (2)     the tenant or another person occupying or intending to occupy the premises5 is a disabled person6;

  3.  

    (3)     the disabled person occupies or intends to occupy the premises as that person's only or main home;

  4.  

    (4)     the tenant is entitled, with the consent of the landlord, to make improvements7 to the premises;

  5.  

    (5)     the tenant applies to the landlord for consent to make a relevant improvement8,
