936. Ground 2A: dwelling house in Wales subject to mortgage granted by fully mutual housing association.

As from a day to be appointed1, the court2 must make an order for possession where the dwelling house3 is subject to a mortgage4 granted, at any time, by a fully mutual housing association5, and:


    (1)     the dwelling house is in Wales6;


    (2)     the tenancy7 was granted by a fully mutual housing association8;


    (3)     the mortgagee is entitled to exercise a power of sale conferred on him either by the mortgage or by statute9; and


    (4)     the mortgagee requires10 possession of the dwelling house for the purpose of disposing of it with vacant possession in exercise of that power11;
