(1) a landlord1 assigns the reversion2 in premises of which he is the landlord under a tenancy3 (whether or not he is landlord of the whole of the premises comprised in the tenancy4); and
(2) immediately before the assignment5, a former landlord of the premises remains bound by a landlord covenant6 of the tenancy ('the relevant covenant')7,
then, regardless of whether or not the former landlord has previously applied8 to be released from the relevant covenant9:
(a) if, immediately before the assignment, the former landlord does not remain the landlord of any other premises demised by the tenancy, he
