Until 14 August 19741 tenancies under which a dwelling was bona fide let at a rent which included payments in respect of the use of furniture2 were excluded from protection3. It may remain important to be able to distinguish between furnished4 and unfurnished tenancies in the following limited circumstances:
(1) for the purposes of deciding whether a tenancy was controlled or regulated5; and
(2) in connection with the exclusion from protection of tenancies granted before 14 August 1974 where there is a resident landlord
