1101. Fixed term tenancies: recovery of possession on tenant's death.

Where a tenancy1 that was a secure tenancy2 for a term certain3 of a dwelling house4 in England5:

  1.  

    (1)     has been vested or otherwise disposed of in the course of the administration of the secure tenant's estate6; and

  2.  

    (2)     has ceased7 to be a secure tenancy8,

and where the secure tenant died on or after 1 April 2012 (but not where he died before that date)9, the landlord10 may apply to the court for an order for possession of the dwelling house let11 under the tenancy12. The court may not entertain proceedings for such an order, however, unless:
