A tenancy1 was not a protected tenancy2 at any time when it was an assured tenancy within the meaning of the Housing Act 19803. Under the Housing Act 1988, old-style assured tenancies were, subject to certain transitional provisions4, converted into assured tenancies for the purposes of that Act5 and no new 1980 Act tenancies may now be created6. The repealed provisions of the 1980 Act7 may, however, still be relevant in some circumstances in order to ascertain the status of a tenancy created before 15 January 19898.
