The extended protection in respect of employees occupying under licences or rent-free lettings1 does not have effect:
(1) where the licence or the rent-free tenancy, as the case may be, was granted in connection with the management of premises in England and Wales2 which, by virtue of a premises licence under the Licensing Act 2003, may be used for the supply of alcohol3 on the premises for consumption on them4; or
(2) where the licence or the rent-free tenancy, as the case may be, was granted pursuant to a contract which imposed on the grantor of it an obligation
