543. Enforcement of right of re-entry etc against residential occupiers restricted to due process of law.

Where any premises are let as a dwelling1 on a lease which is subject to a right of re-entry or forfeiture, it is not lawful to enforce that right otherwise than by proceedings in the court2 while any person is lawfully residing in the premises or part of them3.

Where any premises:

  1.  

    (1)     have been let as a dwelling under a tenancy4 which is neither a statutorily protected tenancy5 nor an excluded tenancy6; or

  2.  

    (2)     are subject to any restricted contract which creates a licence7; or

  3.  

    (3)     are occupied as a dwelling under a licence, other than an excluded licence8,
