Any release of a person from a covenant1 by virtue of the Landlord and Tenant (Covenants) Act 1995 does not affect any liability of his arising from a breach of the covenant occurring before the release2. Where:
(1) by virtue of the Landlord and Tenant (Covenants) Act 1995, a tenant3 is released from a tenant covenant4 of a tenancy5; and
(2) immediately before the release, another person is bound by a covenant of the tenancy imposing any liability or penalty in the event of a failure to comply with that tenant covenant6,
then, as from the release of the tenant,
