Where a landlord1 makes an application to the court to exercise overriding residential rights2:
(1) any notice previously given by the tenant3 of his desire to have the freehold or an extended lease4 of the house5 and premises6 is suspended until the time when an order allowing the application7 or an order dismissing the application becomes final8 or the application is withdrawn; and
(2) on an order allowing such an application becoming final, the tenant's notice ceases to have effect, but the tenant is not required to make any payment to the landlord in respect of costs incurred
