The parties' rights may also be affected by express covenants relating to trees, such as a covenant by the landlord to provide for the delivery of timber for repairs or a covenant by the tenant to restrain interference with trees, whether they are included in the demise or excepted. Under a covenant by the landlord to deliver timber growing on the premises sufficient for the repair of those premises, he must deliver timber sufficient in quality as well as in quantity1.
Where trees are not excepted out of a demise, the tenant may nevertheless be placed under special restrictions as
