If a previous tenancy has expired by effluxion of time or has been determined by surrender by operation of law, the right to remove fixtures is carried forward into the new tenancy1. Where there is an express surrender, the question must be determined in accordance with the provisions of the deed but, in the absence of an express renunciation of the right to remove tenant's fixtures, the right carries forward into the new tenancy
