589. Duty to pay accrued uncommitted service charges.

Where the right to manage premises1 is to be acquired by an RTM company2, a person who is:

  1.  

    (1)     landlord3 under a lease4 of the whole or any part of the premises5;

  2.  

    (2)     party to such a lease otherwise than as landlord or tenant6; or

  3.  

    (3)     a manager appointed by a tribunal (or court) under Part II of the Landlord and Tenant Act 19877 to act in relation to the premises, or any premises containing or contained in the premises8,

must make to the company a payment equal to the amount of any accrued uncommitted service charges9 held by him
