103. Covenant to observe covenants in head lease and as to indemnity.

On the granting of an underlease, the obligations of the head lease in respect of the payment of rent, and the observance of the covenants in respect of any of the property in the head lease which is not comprised in the underlease, are usually imposed by express covenant on the underlandlord, while the undertenant covenants for payment of his own rent and enters into covenants in respect of the sub-demised property corresponding to those in the head lease; and on either side the covenants may be accompanied by an express covenant of indemnity1.
