If at any time a tenancy1 becomes a protected tenancy2 because the landlord housing association3 ceases to satisfy the conditions for exemption4, the tenancy is a regulated tenancy5 and the housing association which is the landlord6 under the tenancy must give notice in writing to the tenant7 informing him that his tenancy is no longer excluded from protection8. If the housing association fails, without reasonable excuse, to give such notice within the period of 21 days beginning on the day on which the tenancy becomes protected, the association is liable on summary conviction to a fine not exceeding level
