381. Conditions of landlord's consent to assignment.

In all leases1 containing a covenant, condition or agreement against assigning, underletting or parting with the possession2, or disposing of the land3 or property4 leased, without licence or consent, unless the lease contains an express provision to the contrary, such covenant, condition or agreement is deemed to be subject to a proviso to the effect that no fine5 or sum of money in the nature of a fine shall be payable for or in respect of such licence or consent6. The proviso so implied does not preclude the right to require payment of a reasonable sum in respect of
