789. Case 11: house required as residence for owner-occupier.

Where a person ('the owner-occupier') who let1 the dwelling house on a regulated tenancy2 had, at any time before the letting, occupied it as his residence3 and:


    (1)     not later than the relevant date4 the landlord5 gave notice in writing to the tenant6 that possession might be recovered under this Case7; and


    (2)     the house has not since the prescribed date8 been let by the owner-occupier on a protected tenancy9 with respect to which the condition mentioned in head (1) above was not satisfied10; and


    (3)     the court is of the opinion that one of certain conditions11 is satisfied12,
